Terms of Service

These terms explain how estimates, scheduling, payment, cancellations, and site conditions work. If you have questions, call or text and we’ll keep it simple.

1) Agreement

By requesting an estimate, approving a written scope, or scheduling work, you agree to these Terms of Service. If any written proposal/estimate conflicts with this page, the written proposal controls for that project.


2) Estimates & Scope

Estimates may be based on measurements, photos, or site visit details. Final pricing can change if site conditions, dimensions, access, or scope differ from what was provided.

  • Scope: Work is limited to items listed in your approved proposal.
  • Exclusions: Unless written, permits, engineering, HOA approvals, and utility relocation are not included.
  • Material variation: Concrete color/finish can vary naturally due to mix, weather, curing, and substrate.

3) Scheduling

Start dates are estimates. Concrete work depends on weather, curing conditions, inspections (if required), and jobsite readiness. We’ll communicate updates as early as possible.

  • Weather delays: Rain, freezing temps, high winds, or extreme heat may shift the schedule.
  • Access: You agree to provide safe access to the work area on scheduled days.

4) Payments

Payment terms are described in your proposal. A deposit may be required to schedule. Remaining balances are typically due at milestones or upon completion.

  • Deposit: If required, deposit reserves labor and material for your project.
  • Final payment: Due when the scope is completed (or as stated in the proposal).
  • Non-payment: Late payments may pause work and/or delay scheduling.

5) Changes & Add-Ons

Any changes to scope (size, finish, thickness, reinforcement, grading, demo, haul-off, etc.) may affect price and schedule. We’ll confirm changes in writing before proceeding when possible.


6) Site Conditions

Underground surprises can happen. You agree to notify us of known issues such as irrigation lines, private utilities, septic systems, or previous repairs beneath the work area.

  • Utilities: Locates may be required before digging/demo.
  • Sub-base: Poor soil, voids, or unexpected base issues may require additional prep.
  • Property protection: We take care, but some dust, debris, and normal construction impact is expected.

7) Warranty & Concrete Notes

Concrete is durable, but it’s not perfect. Minor hairline cracks can occur as part of normal curing and seasonal movement. Warranty terms (if any) are defined in your written proposal.

  • Cracking: Not all cracks can be prevented; control joints help manage where they occur.
  • Sealing: If sealing is included, maintenance re-seals may be recommended depending on wear and weather.
  • De-icers: Some de-icing salts/chemicals can damage concrete; follow care recommendations.

8) Photos & Marketing

We may take before/after photos for quality control and portfolio use. If you prefer no marketing use, tell us in writing before the project starts.


9) Liability

To the extent permitted by law, Mendoza Concrete is not responsible for indirect or consequential damages. Our responsibility is limited to the scope described in the approved proposal.

Nothing in these terms limits rights that cannot be limited under applicable law.


10) Governing Law

These terms are governed by the laws of the State of Colorado (and applicable local laws), unless a written agreement states otherwise.
